Dead Dad's Will Tells Gay Son To Marry A Woman, Or Else...
Before Frank Mandelbaum died, he wrote into his will that none of his money should go to his son Robert's child if Robert had not married the child's mother within six months of the child's birth.
And shortly after a surrogate gave birth to his son Cooper, Robert did marry--he married a man named Jonathan O'Donnell (both pictured)
Now Robert (who happens to be a judge) is battling his deceased father's dying stipulation in a Manhattan Surrogate Court so that his 16-month-old son might recieve the $180,000 trust Frank set aside for each of his three grandchildren.
According to The New York Post, Robert claims that the will's heterosexual marriage requirement contradicts New York's marriage equality law which requires courts to treat same and opposite-gender couples equally.
Robert said that his father's will “imposes a general restraint on marriage by compelling Robert Mandelbaum... to enter into a sham marriage,” expecting Robert to enter either a celibate marriage or one full of gay, extramarital affairs.
Meanwhile, Frank's wife, Anne Freeman believes that Robert should be excluded from the inheritance. But no word on where the money would otherwise.
It's odd that Frank would give his gay son a homophobic middle finger in his final testament, especially since Robert's boyfriend regularly attended family dinners and vacations.
Perhaps dad penned the letter long ago and simply forgot to change it? Or was this dad's secret plan to turn his son "straight" from beyond the grave? Spooooooky!
It it just us, or does this sound like the plot of a wacky, romantic comedy in which Robert temporarily marries a woman and plays it straight, just to get his inheritance?
For Robert, Cooper and Robert's husband, it’s probably more like a drama.
